Introduction
Welcome to FRESHGARDEN. These Terms of Service govern your use of our website located at freshgarden.uk and form a binding legal agreement between you and FRESHGARDEN. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, then you may not use our website or services.

Orders and Contract Formation
Products displayed on our website are an invitation to treat, not a binding offer. When you place an order you make an offer to buy. Our acknowledgement email confirms receipt only. A binding contract is formed when we send you a dispatch confirmation.

All prices are shown in GBP (£) and include VAT where applicable. We accept all major credit and debit cards, including Visa, Mastercard, American Express and Discover. If a price has been listed incorrectly, we will contact you before dispatch to confirm whether you wish to proceed at the correct price or cancel.

Delivery
We dispatch within 1–2 working days and delivery typically takes 4–6 working days. Total time from order to delivery is therefore normally 5–8 working days. We deliver to the United Kingdom. Risk in the goods passes to you on delivery.

We sell brand-new goods in their original packaging only.

Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have 14 days from receiving your goods to cancel your order without giving a reason, and a further 14 days to return them. We also offer a voluntary 30 days return window. See our Refund Policy for the full process.

Faulty Goods
Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have a 30-day right to reject for a full refund, and thereafter a right to repair or replacement. All products sold by FRESHGARDEN are additionally covered by a 2 years warranty against defects.

Intellectual Property Rights
Other than the content you own, which you may have opted to include on this Website, FRESHGARDEN and/or its licensors own all the intellectual property rights and materials contained on this Website. You are granted a limited licence only for purposes of viewing the material contained on this Website.

Restrictions
You are specifically restricted from:

Publishing any Website material in any other media
Selling, sublicensing, and/or otherwise commercialising any Website material
Publicly performing and/or showing any Website material
Using this Website in any way that is or may be damaging to this Website
Using this Website in any way that impacts user access to this Website
Using this Website contrary to applicable laws and regulations, or in any way that may cause harm to the Website, or to any person or business entity
Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website

Your Content
By submitting content to our Website (such as product reviews or comments), you grant FRESHGARDEN a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media. Limitation of Liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any matter that cannot lawfully be excluded — including your rights under the Consumer Rights Act 2015. Subject to that, our total liability in connection with any order is limited to the price you paid for it, and we are not liable for indirect or consequential loss, or loss of profit arising from business use.

Events Outside Our Control
We are not liable for delays or failures caused by events beyond our reasonable control, including extreme weather, carrier disruption, industrial action or failure of public networks.

Indemnification
You indemnify FRESHGARDEN against any liabilities, costs, demands, causes of action, damages, and expenses arising from your breach of any of the provisions of these Terms.

Severability
If any provision of these Terms is found to be invalid under any applicable law, that provision shall be deleted without affecting the remaining provisions.

Variation of Terms
FRESHGARDEN may revise these Terms at any time. The version published on freshgarden.uk at the time you place an order is the version that applies to that order.

Assignment
FRESHGARDEN may assign, transfer, and subcontract its rights and/or obligations under these Terms. You may not assign, transfer, or subcontract any of your rights and/or obligations under these Terms without our consent.

Entire Agreement
These Terms constitute the entire agreement between FRESHGARDEN and you in relation to your use of this Website, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
